1. Introduction

Welcome to Volimy.

Volimy is a technology-enabled marketplace platform that connects customers with independent water suppliers, water jar distributors, packaged drinking water providers, and water tanker operators across India.

By accessing or using the Volimy website (volimy.com), mobile application, or any related services, you agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, our Refund & Cancellation Policy, and our Cookie Policy.

If you do not agree with any part of these Terms, please do not access or use the platform.

These Terms apply to all users of the platform including customers, water suppliers, delivery staff, and any other persons accessing Volimy's services.

2. Platform Nature

Volimy operates solely as a technology facilitation platform.

Volimy does not:

  • Manufacture water products
  • Process or purify water products
  • Store or warehouse water products
  • Transport or deliver water products
  • Own, operate, or manage any supplier business
  • Employ supplier staff, delivery personnel, or agents
  • Guarantee the quality, safety, or purity of any water product listed on the platform

Volimy only facilitates communication, discovery, ordering, subscription management, and transaction coordination between customers and independent water suppliers.

All water supply, delivery, and fulfilment activities are carried out by independent third-party suppliers who are solely responsible for their operations, products, and compliance.

3. User Eligibility

To access and use Volimy, you must:

  • Be at least 18 years of age
  • Be legally capable of entering into binding contracts under applicable Indian law
  • Provide accurate, complete, and current information during registration
  • Maintain the confidentiality of your account credentials (mobile number, OTP, password)
  • Not share your account with any third party
  • Notify Volimy immediately if you suspect any unauthorised access to your account

You are fully responsible for all activities conducted through your account. Volimy shall not be liable for any loss or damage arising from your failure to maintain account confidentiality.

4. Orders

Orders placed through Volimy are requests transmitted to independent suppliers on your behalf.

Supplier acceptance is required before any order is confirmed. Suppliers reserve the right to:

  • Accept orders
  • Reject orders without providing a reason
  • Reschedule deliveries due to operational constraints
  • Cancel orders due to unavailability, weather, or other factors

Volimy does not guarantee supplier availability, acceptance, or fulfilment of any order placed on the platform.

An order confirmation notification from Volimy confirms that the request has been transmitted to the supplier — it does not constitute a guarantee of delivery.

5. Pricing

Product prices, delivery charges, and tanker rates displayed on the platform are determined solely by independent suppliers.

Volimy does not control:

  • Product pricing or minimum order values
  • Delivery charges or tanker rates
  • Supplier-offered discounts or promotions
  • Price changes by suppliers at any time

Prices may vary by location, supplier, demand, product availability, and delivery requirements. Volimy makes no representation that prices displayed are the lowest available in the market.

6. Supplier Responsibilities

Each water supplier operating on the Volimy platform is an independent business and is solely responsible for:

  • Product quality, water purity, and water safety
  • Compliance with all applicable regulations including FSSAI, BIS, and state-level water quality standards
  • Accurate delivery execution — quantities, schedules, and addresses
  • Packaging integrity and hygiene
  • Accurate billing and invoicing
  • Providing customer service for their own orders
  • Maintaining valid licences and registrations required for their water supply business

Volimy shall not be liable for any deficiency, negligence, or misconduct in supplier performance. Any dispute regarding product quality, delivery failure, or billing must be raised directly with the supplier, with Volimy's Grievance Officer available for escalation as described in Section 14.

7. Customer Responsibilities

By using Volimy, customers agree to:

  • Provide accurate and complete delivery address details
  • Ensure that a responsible person is available at the delivery address to receive the order
  • Make timely payments for all orders and subscriptions as per agreed terms
  • Return empty jars or containers to delivery personnel as required by the supplier
  • Use the platform only for lawful purposes and in compliance with these Terms
  • Treat suppliers, delivery personnel, and Volimy staff with respect
  • Not misuse, manipulate, or attempt to defraud the platform or its users

8. Subscription Services

Volimy allows customers to set up recurring water supply delivery plans ("Subscriptions") with participating suppliers.

Customers acknowledge that:

  • Subscription deliveries are subject to supplier availability and operational capacity
  • Volimy does not guarantee uninterrupted or timely subscription fulfilment
  • Subscription schedules may be adjusted due to operational constraints, weather conditions, public holidays, or regulatory requirements
  • Customers may pause or cancel subscriptions as per the terms stated in our Refund & Cancellation Policy
  • Continued subscription usage constitutes acceptance of any schedule adjustments communicated by the supplier

9. Payments & Refunds

All payments on Volimy are facilitated through secure third-party payment processors including Razorpay, UPI, PhonePe, and Paytm, or collected directly by suppliers as cash payments.

Volimy does not:

  • Store payment card details, UPI credentials, or net banking information
  • Directly collect payments on behalf of suppliers in all cases
  • Guarantee refunds for supplier-related disputes

Payment disputes between customers and suppliers must be raised within 7 days of the relevant transaction date.

10. Data Privacy

Volimy collects and processes personal data including but not limited to:

  • Mobile numbers and account credentials
  • Delivery addresses and GPS location data
  • Order history and delivery records
  • Payment transaction data
  • Device information and usage data

All personal data is collected, stored, and processed in accordance with India's Digital Personal Data Protection Act (DPDPA) 2023 and applicable regulations.

By using Volimy, you consent to the collection and use of your personal data as described in our Privacy Policy.

You have the right to request access to, correction of, or deletion of your personal data by contacting us at info@volimy.com.

11. GST & Taxation

GST applicable on water products and delivery services is determined by and is the sole responsibility of the respective independent supplier.

Volimy facilitates GST invoice generation as a technology service only. Volimy is not responsible for:

  • The accuracy of GST rates applied by suppliers
  • Supplier GST registration or compliance
  • Filing of GST returns by suppliers
  • Any tax liability arising from supplier transactions

Customers requiring GST invoices for business purchases should verify supplier GSTIN details directly with the supplier. Volimy provides invoice generation tools but does not verify supplier tax compliance.

12. Intellectual Property

All trademarks, logos, brand names, designs, software, platform architecture, content, and branding associated with Volimy are the exclusive property of Volimy or its licensors.

No content, material, or intellectual property from the Volimy platform may be:

  • Copied, reproduced, or duplicated
  • Distributed, published, or transmitted
  • Modified, adapted, or used to create derivative works
  • Used for commercial purposes without prior written permission from Volimy

Unauthorised use of Volimy's intellectual property may result in civil and criminal liability under applicable Indian law.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Volimy shall not be liable for:

  • Water quality issues, contamination, or health concerns arising from supplier products
  • Product defects or packaging failures
  • Delivery delays, missed deliveries, or incorrect deliveries by suppliers
  • Supplier misconduct, negligence, or regulatory violations
  • Pricing disputes between customers and suppliers
  • Refund disputes arising from supplier transactions
  • Any indirect, incidental, special, or consequential damages arising from platform use
  • Loss of data, revenue, or business opportunity

Users expressly acknowledge and agree that Volimy acts solely as a technology facilitator and that all liability for water supply, delivery, and product quality rests with the independent supplier.

Volimy's total liability to any user for any claim arising from platform use shall not exceed the value of the specific transaction giving rise to the claim.

14. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules 2020 and the Information Technology Act 2000, Volimy has appointed a Grievance Officer to address user complaints.

Users are encouraged to raise disputes with the Grievance Officer before initiating any legal proceedings. Volimy will make reasonable efforts to resolve complaints amicably within 15 working days of receipt.

15. Account Suspension & Termination

Volimy reserves the right to suspend, restrict, or permanently terminate any user account — without prior notice — for:

  • Fraud, misrepresentation, or identity theft
  • Abuse of platform services or other users
  • Violation of applicable Indian laws or regulations
  • Breach of any provision of these Terms
  • Any activity that Volimy reasonably believes may cause harm to the platform, other users, or third parties

Upon termination, your right to access and use Volimy ceases immediately. Any pending orders may be cancelled without liability to Volimy.

16. Force Majeure

Volimy shall not be liable for any failure, delay, or disruption in services caused by circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters, floods, earthquakes, or extreme weather events
  • Epidemic, pandemic, or public health emergencies
  • Government orders, regulations, or regulatory actions
  • Internet or telecommunications outages
  • Power failures or infrastructure disruptions
  • Civil unrest, strikes, or lockdowns

In such events, Volimy will make reasonable efforts to restore services as quickly as practicable.

17. Amendments

Volimy reserves the right to modify, update, or revise these Terms at any time.

When material changes are made:

  • Users will be notified via the Volimy app, registered mobile number, or email
  • The "Last Updated" date at the top of this page will be revised
  • Continued use of the platform after notification of changes constitutes acceptance of the revised Terms

If you do not agree with any revised Terms, you must discontinue use of the platform immediately.

It is your responsibility to review these Terms periodically for any updates.

18. Governing Law & Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of India.

Jurisdiction: Any dispute, claim, or controversy arising out of or relating to these Terms, or the use of the Volimy platform, shall be subject to the exclusive jurisdiction of courts located in Jaipur, Rajasthan, India.

Dispute Resolution Process: Before initiating any legal proceedings, users agree to:

  1. Raise the dispute with Volimy's Grievance Officer (Section 14)
  2. Allow 15 working days for Volimy to attempt amicable resolution
  3. Proceed to legal proceedings only if resolution is not achieved
